Since issuing its first online gaming licence in 1996, Curacao has rapidly developed into one of the most popular licencing jurisdictions in the world.

Until 2023, the Curacao licence was known as being inexpensive and easy to obtain. The legislation has since been amended and a new licencing regime introduced. Consequently, the licencing conditions have become more onerous and gaming operators are subject to a higher level of regulatory supervision. The cost of the licence has also increased substantially, rendering it inaccessible for most startups.

The Curacao licence is best suited for established gaming operators, who want to benefit from its global acceptance, earnt over almost three decades.

How to start a gambling company in Curacao

Curacao gaming licences may only be issued to companies incorporated in Curacao. The first step is therefore to register a company in Curacao. The company must have a local registered office and appoint at least one director who is resident in Curacao. After the company has been set up, we will prepare the gaming licence application. This will entail preparing a business plan, containing financial projections and detailing the company’s intended activities and target markets. A policy manual will need to be prepared, with particular attention to be paid to the topics of anti-money laundering, responsible gaming and fair play. The company will also be required to submit detailed information about its directors, shareholders, beneficial owners and other key persons for compliance purposes.

The application is submitted to the Curacao Gaming Control Board (CGCB). At this stage, the licence application fee needs to be paid.

The Board will review the application and carry out due diligence checks on all persons involved. If all documents submitted are accurate and complete, the application will normally be processed within one to three months. Once the licence is approved, the annual licence fee will need to be paid, so that the licence may be issued. The company may then commence its gaming operations.

The fees listed below are payable to the Curacao Gaming Control Board in respect of both, B2C and B2B licences. The fees are quoted in Netherlands Antillean Guilders (ANG), the national currency of Curacao.

  • Application fee – ANG 9,000
  • Due diligence fee – ANG 250 to ANG 500 per person, depending on their role in the company
  • Annual fee – ANG 48,000

 

In addition, the following fees apply to B2C licences only:

  • Monthly fee – ANG 4,000 payable each month in advance
  • Domain fee – ANG 500 per domain per year (the first 40 domains are included in the licence)

Types of licences for gambling in Curacao

Curacao offers two classes of licence:

B2C licence

The B2C (business-to-consumer) licence allows the operator to engage in all classic remote gambling activities, such as casino, sports betting, poker, lottery and bingo

B2B licence

The B2B (business-to-business) licence is intended for those who provide gambling-related services, such as casino games and software development, to B2C operators

    Updates to Curacao gaming licence in 2024

    A fundamental overhaul of the Curacao gaming licencing regime was announced in 2023 and took effect in 2024.

    Up to that time, four master-licences existed, which had been issued by the Ministry of Justice several years earlier. The master-licences were renewable every five years. Anybody wishing to obtain a licence in Curacao had to apply for a sub-licence from one of the four master-licence-holders. This resulted in confusion among operators and players and inconsistent standards being applied by the four master-licence-holders. Coupled with the fact that Curacao gaming licences were relatively inexpensive to obtain and not subject to onerous regulatory supervision, the reputation of the jurisdiction’s gaming licence was not held in very high regard, especially in later years.

    Prompted by the Netherlands, of whose kingdom Curacao is a constituent country, Curacao announced the discontinuation of the existing licencing regime as the four master-licences expired. A new regime was introduced, the aim of which was to establish a centralised and uniform licencing process and to improve the reputation of the Curacao gaming licence. The main changes can be summarised as follows:

    • The sole licencing authority is now the Curacao Gaming Control Board
    • Two classes of licence were introduced, being B2C and B2B
    • Sub-licencing is no longer permitted
    • Licencees are subject to strict regulations, particularly in the areas of compliance, transparency, financial stability and responsible gaming
    • Licencees must maintain a local physical presence in Curacao
    • Licences are now issued for one year and renewable annually
    • The fees for applying and maintaining a Curacao gaming licence are substantially higher

     

    While the changes were initially met with some apprehension, the current consensus among the gaming industry is that the Curacao licence now enjoys an enhanced reputation and is well-placed to meet the expectations of players and operators alike for many years to come.

    Gambling legislation in Curacao

    Being an established offshore financial centre, Curacao introduced legislation to regulate online gambling in 1993. It was one of the first jurisdictions in the world to do so. The law was known as the National Ordinance on Offshore Games of Hazard (NOOGH) and adopted the master-licence and sub-licence model. The first licences were issued under the NOOGH in 1996. In total, four master-licences were issued.

    The Curacao Gaming Control Board (CGCB) was established in 1999 for the purpose of supervising licencees.

    In July 2023, the National Ordinance on Games of Chance (LOK) was passed, allowing for a more robust and centralised regulatory regime. The CGCB started to accept applications under the new regime in September 2023. Licencees were allowed to operate under their existing sub-licences during a transition period, which ended on 24 December 2024. From that date onwards, all operators are required to hold a licence issued by the CGCB.
