Global expertise in online gaming licencing

The first online casino was launched by Microgaming in 1994. 30 years later, the global online gaming industry is estimated at $100 billion annually. Very few industries can boast such a remarkable rate of growth!

The Netstorm Consulting team advised its first online gaming client in 2001. Since then, we have helped hundreds of operators in successfully setting up and growing their gaming businesses.

Choosing the right gaming licence will depend on each operator’s individual circumstances and requirements. You can rely on our decades-long knowledge and expertise to help you make the correct choice. Once the licence has been decided, our consultants will assist you with other critical matters, including setting up your corporate structures, banking solutions, payment processing and compliance.

Who needs a gambling licence?

In today’s environment of increased compliance, business accountability and transparency obligations globally, it is impossible for any respectable online gaming business to operate without a suitable licence. A gambling licence provides several benefits:

  • By holding the necessary licence, the operator is able to operate in their target markets
  • It reassures players that the gaming operator adheres to strict standards in respect of fair play and responsible gaming
  • It provides players with access to a regulatory body, which can resolve disputes with the gaming operator
  • The gaming operator’s bankers and payment processors are assured that the gaming operator complies with strict anti-money laundering regulations

Advantages of having a gaming licence

Gaming licence requirements

While each licencing authority applies its own regulations, the following would be typical requirements for all licences:

  • The individuals involved in the business (shareholders, directors, key persons) must be fit and proper
  • The operation must be adequately funded and financially viable, as demonstrated in the business plan
  • The business needs to adopt a suitable policy manual, addressing matters such as anti-money laundering, fair play and player protection
  • The gaming software to be used will need to be certified as compliant by an independent expert
  • The operator will need to pay the relevant application and ongoing fees to the regulator

How to get a gaming licence

Types of online gaming licences

Gaming licences can broadly be grouped into three types.

Casino and related games

This licence regulates gaming activities between operator and player (B2C) such as casino, poker, lottery and bingo

Sports betting

A sports betting licence allows the operator to accept bets from players on sporting events

Software provider

This is a B2B (business-to-business) licence and is applicable to providers of gambling software to gaming operators

Other types of gaming licences often referred to are the following:

  • Fantasy sports licence: for operators who offer betting on fantasy sports
  • Crypto gaming licence: applies to operators who accept payments in cryptocurrencies

Anjouan

Anjouan has been issuing remote gambling licences since 2005.

A single B2C licence allows the operator to engage in all forms of gambling activities, including casino, poker, bingo, lottery and sports betting.

Alternatively, a B2B licence is available for gaming software providers.

Licences can be issued to companies registered in any jurisdiction and they allow white-labelling but not sub-licencing.

Anjouan is fast becoming the most popular jurisdiction to obtain a gaming licence, largely as a result of its very efficient application assessment process and affordable fee structure. It is particularly favoured by new entrants to the market.

Points to consider when choosing a licencing jurisdiction

Choosing the right jurisdiction to apply for your gaming licence is a key consideration for the success of your business. Several factors need to be taken into account in reaching this decision, including the following (although this is not an exhaustive list):

  • Will the licence allow you to operate in your target markets?
  • Is the licence acceptable to your software providers, payment method providers and bankers?
  • Is there any obligation to maintain a physical presence in the jurisdiction?
  • Are you able to meet the ongoing compliance and reporting requirements?
  • Can your business meet the licence fees or should you opt for a cheaper option for the time being?
  • Have you considered the tax implications of the specific licence?

By understanding your specific circumstances and objectives, Netstorm Consulting will guide you in making the correct choice.

    Gaming licence costs

A gaming licence carries various costs, which can be broken into three categories.

    Initial costs

A non-refundable application fee is normally payable at the time of submitting the application for a licence. Once the application is approved, you will be asked to pay a fee for the licence to be issued.

    Ongoing costs

The licence may carry an obligation to pay a fixed annual or monthly fee. In some cases, the fee may be calculated on the basis of gaming revenue, which may also be in addition to a fixed fee.

    Indirect costs

Other incidental costs should not be ignored, such as employing key officers and maintaining a physical presence in the jurisdiction. Also any tax implications imposed on the gaming company.

The gaming operator will need to have a clear understanding of the financial commitment involved before embarking on the journey towards obtaining a gaming licence.

Risks of operating an online gaming business without a licence

In today’s world of increased transparency and regulation, it would be impossible for an online gaming business to operate without a valid licence, as it would be presented with several obstacles:

    • It would not be able to access any of the recognised gaming software vendors
    • No bank will open an account for an unlicenced gaming operator
    • Payment method providers will only transact with licenced operators
    • Players will not trust an unlicenced gaming website and will therefore not wish to register on it

    FAQ about gaming licences

    Answers to some frequently-asked questions

The holder of a gaming licence can set up an unbranded, fully operational website, including gaming software, payment processing, back office support and compliance functions. The licencee may then enter into a joint venture with a third party, such as a well-known soccer team, allowing them to customise the site with their own branding. The third party will focus on marketing and player acquisition, while the licencee will handle all aspects of the business. This arrangement is known as white-labelling.

Sub-licencing is an arrangement whereby the holder of a gaming licence (the "master licencee") allows third party gambling businesses (the "sub-licencees") to operate under the master licencee's gaming licence in exchange for a fee. This practice was common in the past in some jurisdictions but is no longer permitted.

No, not always. Curacao licences may only be issued to companies registered in Curacao but Malta, Anjouan and Kahnawake are able to licence foreign companies.

All licenced gaming sites are required to display a seal, which is issued to them by their regulator. By clicking on the seal, a player is taken to the licencing authority's official website, which will confirm the validity of the licence.

The licence of choice for start-up gaming operators is Anjouan, due to its low cost and speed of application processing.
